These Terms of Service (the “Terms”) form an agreement between you and CartsFlow, of 256 Chapman Road STE 105-4, Newark, DE 19702, United States, which operates the website https://cartsflow.com and the services offered through it. 2. Acceptance of these Terms
By accessing the website, creating an account, or purchasing a product or subscription, you agree to these Terms. If you do not agree, please do not use the service. You must be at least 16 years old, and if you are agreeing on behalf of a company you confirm you are authorised to bind it.
3. The service
CartsFlow provides eCommerce customer-journey tracking and analytics, including data collection from your connected store, reporting, and related tools. We may add, change, or withdraw features over time, and will give reasonable notice before removing functionality that materially affects paying customers.
4. Your account
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for activity under your account. Tell us promptly at info@cartsflow.com if you believe your account has been used without your authorisation.
5. Plans, billing and renewals
Paid plans are billed in advance at the price and interval shown at checkout. Unless stated otherwise, subscriptions renew automatically for successive periods until cancelled. You may cancel at any time and cancellation takes effect at the end of the current billing period. Prices exclude taxes unless stated.
6. Refunds
Refunds are handled under our Refund and Returns Policy, which forms part of these Terms.
7. Acceptable use
You must not misuse the service, including by attempting to gain unauthorised access, interfering with its operation, scraping it at scale, reselling it without our agreement, or using it unlawfully. Our Acceptable Use Policy sets this out in full and forms part of these Terms.
8. Your data
You retain ownership of the data you or your store send to the service. You grant us the licence needed to host and process that data in order to provide the service. How we handle personal data is described in our Privacy Policy and Cookie Policy.
9. Intellectual property
The website, software and materials we provide remain the property of CartsFlow and its licensors. Nothing in these Terms transfers ownership of them to you.
10. Availability
We aim to keep the service available and reliable, but we do not guarantee uninterrupted operation. Maintenance, third-party outages and events outside our reasonable control may affect availability.
11. Warranties and liability
The service is provided on an “as is” basis to the extent permitted by law. We are not liable for indirect or consequential loss, or for loss of profits, revenue or data. Nothing here limits liability that cannot lawfully be limited. Where liability is capped, it is capped at the amount you paid us in the twelve months before the claim arose.
12. Suspension and termination
You may stop using the service at any time. We may suspend or end access where these Terms are breached, where required by law, or where continued provision would expose us or other users to risk. We will give notice where it is reasonable to do so.
13. Changes to these Terms
We may update these Terms. Where a change materially affects your rights we will give reasonable notice, and continued use after the change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, and the courts of that State have jurisdiction, without affecting any mandatory consumer rights you have where you live.
